Hiring in South Africa: Leave Requirements by Law

The Basic Conditions of Employment Act (BCEA) sets the national floor for time off for South Africans. Below are the minimum requirements by law:

  • Annual leave - minimum 15 paid leave days per year
  • 30 paid sick leave days over a 3 year cycle
  • Compassionate leave - 3 paid days per year (does not carry over); death of child, spouse, parents, adoptive parents, extreme sickness of child
  • Paternity leave - 10 days unpaid leave (claim UIF government fund)
  • Maternity leave - 4 months unpaid leave (claim UIF government fund)
